During a team-building session in August 2021, employees of the blood donation service took part in a personality test based on the Star Wars universe.

What was supposed to be a convivial moment turned into a nightmare when a colleague took it upon herself to fill in the questionnaire for Lorna Rooke, deliberately associating her with the Darth Vader character.

The psychological consequences of a joke

This comparison, far from being anodyne, deeply affected Ms. Rooke. Feeling stigmatized and marginalized within her team, she experienced this association as a form of moral harassment.

The psychological impact was such that she eventually decided to resign from her position.

Justice recognizes the damage

Judge Kathryn Ramsden clearly ruled that the comparison was offensive, pointing out that Darth Vader represents “a legendary villain” in the collective imagination.

This legal recognition of the damage suffered led to an award of £30,000 in damages, or around €35,000.

A nuanced verdict

Although the plaintiff was successful in her claim for pain and suffering, her other claims were rejected.

Charges of unfair dismissal and disability discrimination were dismissed, demonstrating a balanced approach to the case.
